آزاد جموں و کشمیر کی قانون ساز اسمبلی میں ڈرامائی انداز میں اسپیکر چوہدری انوارالحق رات گئے ہونے والی ووٹنگ میں نئے وزیراعظم منتخب ہوگئے۔ تفصیلات کے مطابق اسپیکر انوارالحق کے انتخاب کے ساتھ ہی سابق وزیراعظم تنویر الیاس کی نااہلی کے بعد شروع ہونے والا جمود بھی ٹوٹ گیا۔
قانون ساز اسمبلی میں نئے وزیراعظم کے لیے ووٹنگ جمعرات کو 1:25 بجے ہوئی اور 31 اراکین نے چوہدری انوارالحق کو ووٹ دیا، جن میں پاکستان پیپلزپارٹی (پی پی پی) کے 12، پاکستان مسلم لیگ(ن) کے 7 اراکین شامل تھے اور ووٹ دینے والے دیگر اراکین حکمران پاکستان تحریک انصاف (پی ٹی آئی) سے تعلق رکھتے ہیں۔
انوارالحق پی ٹی آئی کی اقتدار میں واپسی یقینی بنانے کے لیے اپنی جماعت کے ساتھ رہے جس کے خلاف متحدہ اپوزیشن نے صدر سلطان محمود کے زیر اثر پی ٹی آئی کے باغی گروپ کی مدد سے حکومت ہتھیانے کی کوشش کر رہے تھے۔
دوسری جانب سابق وزیراعظم اور پی ٹی آئی کے علاقائی صدر سردار تنویر الیاس نے کہا کہ پارٹی نے کسی امیدوار کا نام نہیں دیاتھا۔
ان کا کہنا تھا کہ ’آج مجھے انوارالحق کی سازش کا علم ہوا ہے، ایک طرف وہ پی ٹی آئی کی قیادت کو جماعت بچانے کا یقین دلا رہے تھے، دوسری طرف وہ اسٹیبلشمنٹ سے معاہدہ کر رہے ہیں۔ یاد رہےکہ آزاد جموں اور کشمیر کی قانون ساز اسمبلی مسلسل چار روزتک نئے وزیراعظم کے انتخاب کے لیے ایوان کی کارروائی شروع نہ کرسکی تھی جہاں حکمران جماعت پاکستان تحریک انصاف (پی ٹی آئی) میں تقسیم کی افواہیں تھیں۔18 اپريل 2023کو ڈپٹی اسپیکر چوہدری ریاض گجر کی زیر صدارت قانون ساز اسمبلی کا اجلاس 11 بجے طلب کیا گیا تھا لیکن 4 گھنٹے سے زائد تاخیر کے بعد تقریباً 3:15 بجے شروع ہوا تھا۔
اسمبلی کے گزشتہ اجلاس کے برعکس کورم پورا تھا جہاں نگران وزیراعظم سمیت حکمران جماعت پاکستان تحریک انصاف (پی ٹی آئی) سے تعلق رکھنے والے 13 اراکین اور مخلوط اپوزیشن کے 18 اراکین شریک تھے۔
ڈپٹی اسپیکر نے بغیر کوئی وجہ بتائے یا قوانین معطل کیے بغیر ایک منٹ سے بھی کم وقت میں ایوان کا سیشن منگل 11 بجے تک ملتوی کرنے کا اعلان کیا تھا,حکمران جماعت کے اراکین ڈپٹی اسپیکر کے اعلان پر خاموشی سے ایوان سے باہر چلے گئے اور اسی طرح اپوزیشن اراکین بھی چلے گئے اور کسی کی جانب سے احتجاج نہیں کیا گیا، موجودہ حالات میں بظاہر اس کا امکان نہیں تھا۔
اس اقدام سے ایسا لگتا تھا کہ حکومت اور اپوزیشن کے درمیان اتفاق رائے سے اسمبلی کا اجلاس ملتوی کیا گیا۔
اسمبلی کے باہر بات کرتے ہوئے اپوزیشن لیڈر چوہدری لطیف اکبر نے کہا تھاکہ ہم التوا کی حکمت عملی روکنے کے لیے بات کریں گے۔
پی ٹی آئی کے مبینہ باغی اراکین جو اطلاعات کے مطابق صدر سلطان محمود کی چھتری تلے جمع رہے تاہم انہوں جماعت سے کنارہ کشی اور آزاد فاورڈ بلاک تشکیل دینے کا باقاعدہ اعلان نہیں کیا تھا۔
پی ٹی آئی میں تقسیم کے حوالے سے حکمران جماعت کے رکن چوہدری رشید سے سوال کیا گیا تو انہوں نے منفی میں جواب دیاتھا۔
انہوں نے کہا تھا کہ اب تک اس طرح کی کوئی چیز نہیں ہوئی، صدر نے وزیراعظم کے انتخاب کے لیے 3 ناموں کا پینل دیا ہے اور اسی طرح سردار تنویر الیاس نے کیا تھا۔
صدر سلطان محمود چوہدری کی جانب سے وزارت عظمیٰ کے لیے نامزد چوہدری رشید کا کہنا تھا کہ اگر انہوں نے تمام دوستوں کا اعتماد حاصل کیا تو وہ ریاست میں درکار اصلاحات کے لیے کام کریں گے۔
ان کا کہنا تھا کہ میں ریاست کے ادارہ جاتی سیٹ اپ کو دوبارہ منظم اور بہترین بنا کر آگے بڑھوں گا۔
دوسری جانب حکمران جماعت پی ٹی آئی وزیراعظم کے امیدوارکے حوالے سے بدستور خاموش تھے۔
نگران وزیراعظم خواجہ فاروق احمد نے دعویٰ کیا تھاکہ ہم نے جان بوجھ کر اپنا مجوزہ امیدوار کا نام روک رکھا ہے کیونکہ ہم اعصاب کی اس جنگ میں چاہتے ہیں اپنے مخالفین کو ردعمل کے لیے کم وقت ملے۔
اس سے قبل نگران وزیراعظم نے کابینہ کے اجلاس کی صدارت کی تھی، جس کے دوران سیاسی صورت حال کی روشنی میں سیکیورٹی اقدامات کا جائزہ لیا گیا۔
نگران وزیراعظم نے آزاد جموں اور کشمیر کے صدر کے لیے پرتعیش گاڑی کی خریداری کے مسئلے پر بات کرتے ہوئے کہا تھاکہ یہ ایک ایسے وقت میں نامناسب اقدام تھا جب ریاست بدترین مالی بحران کا سامنا کر رہی تھی۔
انہوں نے کہا تھا کہ گاڑی کی خریداری کا عمل ختم کردینا چاہیے۔چیف سیکریٹری نے مذکورہ معاملے پر کابینہ کو آگاہ کیاتھا کہ گاڑی کا ٹینڈر منسوخ کردیا گیا ہے اور اس حوالے سے اخبارات میں اشتہارات بھی دیے گئے ہیں۔ خیال رہے کہ 11 اپريل 2023کو آزاد کشمیر ہائی کورٹ کے فل کورٹ بینچ نے وزیر اعظم سردار تنویر الیاس کو توہین عدالت کے الزامات پر اسمبلی رکنیت سے نااہل قرار دے دیا تھا۔فل کورٹ بینچ کے فیصلے کے بعد سردار تنویر الیاس، وزیر اعظم آزاد کشمیر کے عہدے سے فارغ ہوگئے تھےبعد ازاں الیکشن کمیشن آزاد کشمیر نے ہائی کورٹ کے فیصلے کی روشنی میں تنویر الیاس کو آزاد جموں و کشمیر قانون ساز اسمبلی کی نشست سے ڈی نوٹیفائی کر دیا تھا۔سماعت میں عدالت نے وزیراعظم آزاد کشمیر کے تین ویڈیو کلپس چلائے تھے، جس میں ہفتے کو ان کی تقریر کا کلپ بھی شامل تھا اور پوچھا کہ کیا وہ الزامات کا سامنا کریں گے۔سردار تنویر الیاس نے نفی میں جواب دیا اور عدالت سے غیر مشروط معافی مانگ لی تھی، تاہم عدالت نے وزیراعظم آزاد کشمیر کی معافی کی درخواست کو مسترد کردیا تھا اور الیاس تنویر کو عدالت برخاست ہونے تک کی سزا سنائی گئی تھی۔واضح رہے کہ آزاد جموں و کشمیر کی اعلیٰ عدلیہ نے تنویر الیاس کو ’عوامی جلسوں میں اپنی تقریروں میں اعلیٰ عدلیہ کے بارے میں تضحیک آمیز ریمارکس‘ کے حوالے سے اپنے مؤقف کی وضاحت کے لیے نوٹسز جاری کیے تھے اور انہیں عدالت طلب کیا گیا تھا۔گزشتہ ہفتے اسلام آباد میں ایک تقریب کے دوران الیاس تنویر نے بالواسطہ طور پر عدلیہ پر الزام عائد کرتے ہوئے کہا تھا کہ عدلیہ حکومت کے کام کو متاثر کر رہی ہے اور حکم امتناع کے ذریعے ایگزیکٹو کے اختیارات میں مداخلت کی جارہی ہے۔
انہوں نے خاص طور پر 15 ملین ڈالر کے سعودی فنڈز سے چلنے والے تعلیمی شعبے کے منصوبے کا حوالہ دیتے ہوئے کہا تھا کہ یہ منصوبہ کھٹائی میں پڑا ہوا ہے کیونکہ عدالت نے اس پر حکم امتناع جاری کر دیا تھا، اسی طرح، انہوں نے ’اربوں روپے کی ٹیکس چوری میں ملوث تمباکو فیکٹریوں کو عدالتوں کی طرف سے کھولنے پر بھی سخت موقف اپنایا تھا‘۔

In a dramatic fashion in the Legislative Assembly of Azad Jammu and Kashmir, Speaker Chaudhry Anwar Haq was elected as the new Prime Minister in the late night voting. According to details, with the election of Speaker Anwar Haq, the stalemate that started after the disqualification of former Prime Minister Tanveer Ilyas was also broken.
Voting for the new prime minister in the Legislative Assembly took place on Thursday at 1:25 pm and 31 members voted for Chaudhry Anwar Haq, including 12 members of the Pakistan People’s Party (PPP), 7 members of the Pakistan Muslim League (N) and Other voting members belong to the ruling Pakistan Tehreek-e-Insaaf (PTI).
Anwar Haq remained with his party to ensure the return of the PTI to power, against which the United Opposition was trying to seize the government with the help of a rebel faction of the PTI under the influence of President Sultan Mehmood.
On the other hand, former prime minister and PTI regional president Sardar Tanveer Ilyas said that the party had not named any candidate.
He said that today I have come to know about the conspiracy of Anwar Haq, on one hand he was assuring the leadership of PTI to save the party, on the other hand he is making a deal with the establishment. It should be remembered that the Legislative Assembly of Azad Jammu and Kashmir could not start the proceedings of the House for the election of a new Prime Minister for four consecutive days where there were rumors of a split in the ruling party Pakistan Tehreek-e-Insaf (PTI). On April 18, 2023, Deputy Speaker Chaudhry Riaz. The session of the Legislative Assembly chaired by Gujjar was convened at 11 am but resumed at around 3:15 pm after a delay of more than 4 hours.
Unlike the previous session of the Assembly, the quorum was complete where 13 members from the ruling party Pakistan Tehreek-e-Insaf (PTI) and 18 members from the mixed opposition participated, including the caretaker prime minister.
The Deputy Speaker had announced the adjournment of the House session till Tuesday 11 am in less than a minute without giving any reason or suspending the rules. Likewise, the opposition members also left and no one protested, which was apparently unlikely in the current circumstances.
With this move, it seemed that the assembly meeting was adjourned by consensus between the government and the opposition.
Speaking outside the assembly, opposition leader Chaudhry Latif Akbar said that we will talk to stop the delay strategy.
The alleged rebel members of PTI who reportedly gathered under the umbrella of President Sultan Mehmood, however, did not formally announce their withdrawal from the party and the formation of the Independent Forward Bloc.
When Chaudhry Rashid, a member of the ruling party, was asked about the split in PTI, he replied in the negative.
He had said that nothing like this has happened so far, the President has given a panel of 3 names to select the Prime Minister and Sardar Tanveer Ilyas did the same.
Chaudhry Rashid, who was nominated for the Prime Minister ship by President Sultan Mahmood Chaudhry, said that if he gained the trust of all his friends, he would work for the necessary reforms in the state.
He said that I will move forward by reorganizing and making the institutional set-up of the state better.
On the other hand, the ruling party PTI remained silent regarding the Prime Minister’s candidate.
Caretaker Prime Minister Khawaja Farooq Ahmad had claimed that we have deliberately withheld the name of our proposed candidate as we want our opponents to have less time to react in this war of nerves.
Earlier, the caretaker prime minister chaired the cabinet meeting, during which security measures were reviewed in the light of the political situation.
The Caretaker Prime Minister while talking about the issue of buying a luxury car for the President of Azad Jammu and Kashmir said that it was an inappropriate move at a time when the state was facing the worst financial crisis.
He had said that the process of purchasing the vehicle should be terminated. The Chief Secretary had informed the cabinet on the above issue that the tender of the vehicle has been canceled and advertisements have also been given in the newspapers in this regard. It should be noted that on April 11, 2023, the full court bench of the Azad Kashmir High Court disqualified Prime Minister Sardar Tanveer Ilyas from assembly membership on charges of contempt of court. After the decision of the full court bench, Sardar Tanveer Ilyas, Prime Minister of Azad Kashmir. Later, the Election Commission of Azad Kashmir de-notified Tanveer Ilyas from the seat of the Azad Jammu and Kashmir Legislative Assembly in the light of the High Court’s decision. Sardar Tanveer Ilyas replied in the negative and sought an unconditional apology from the court. The plea of amnesty was rejected and Ilyas Tanveer was sentenced till the dismissal of the court. It should be noted that the High Court of Azad Jammu and Kashmir accused Tanveer Ilyas of ‘derogatory remarks about the High Judiciary in his speeches in public meetings. ‘ had issued notices to clarify their stand and were summoned to court.
During an event in Islamabad last week, Ilyas Tanveer indirectly accused the judiciary, saying that the judiciary is influencing the work of the government and interfering with the powers of the executive through injunctions.
Referring specifically to the $15 million Saudi-funded education sector project, he said the project was in limbo because a court had issued an injunction against it. The courts also took a strict stance on the opening of tobacco factories involved in tax evasion worth billions of rupees.
