.بھارت کی جانب سے مقبوضہ جموں و کشمیر پر مسلط کیے گئے غیر قانونی محاصرے اور ظلم و ستم کی سیاہ رات کو اب طویل سات برس بیت چکے ہیں۔ 5 اگست 2019 کا وہ دن تاریخ کے ان تاریک ترین ابواب میں شمار ہوتا ہے جب مودی سرکار نے عالمی قوانین، اخلاقیات اور خود اپنے آئین کی دھجیاں اڑاتے ہوئے وادی کی خصوصی شناخت پر شب خون مارا تھا۔
درحقیقت 5 اگست 2019 مقبوضہ جموں و کشمیر کی تاریخ کا سب سے المناک، دردناک اور سیاہ ترین دن ہے جب کشمیر کی حقِ خودارادیت پر حملہ کرتے ہوئے اس کی خود مختاری کو چیلنج کیا گیا۔
شاعرِ مشرق علامہ اقبال نے وادی کے اسی حسن اور وہاں کے جگر سوز حالات کی ترجمانی کرتے ہوئے کیا خوب فرمایا تھا:
(”توڑ اس دستِ جفا کیش کو یارب”
”جس نےروحِ آزادیِ کشمیر کو پامال کیا ہے”)
اپریل 2019 میں بھارت میں ہونے والے عام انتخابات میں آر ایس ایس نواز بی جے پی جماعت کامیاب ہوئی اور نریندر مودی نے دوبارہ اقتدار کی کرسی سنبھالی۔ اقتدار میں آنے کے بعد اس حکومت نے سنگ دلی و عصبیت کا سب سے بڑا قدم اٹھایا اور بی جے پی حکومت کے قیام کو ابھی چار ماہ ہی ہوئے تھے کہ انہوں نے پارلیمان سے اندھے قوانین پاس کرنے کا گھناؤنا عمل شروع کیا۔ اسی کڑی کے تحت 5 اگست 2019 کو بھارتی پارلیمان نے آرٹیکل 370 کا خاتمہ کیا، جو کشمیر کو خصوصی حیثیت دیتا تھا اور اسے اپنا آئین اور اپنا جھنڈا فراہم کرتا تھا۔ اس آرٹیکل کے خاتمے سے کشمیر کی خصوصی حیثیت ختم کی گئی اور اس کے آئین اور جھنڈے کو بھی ضبط کر لیا گیا۔اسی پر بس نہیں ہوا، بی جے پی حکومت نے صدارتی حکم نامے کے ذریعے دفعہ 35 اے کو بھی ختم کر دیا، جس کے مطابق کوئی شخص صرف اسی صورت میں جموں و کشمیر کا شہری ہو سکتا تھا اگر وہ وہاں پیدا ہوا ہو۔
دفعہ 35 اے کے خاتمے کے بعد بھارت کی دوسری ریاستوں سے غیر مقامی لوگوں کی کشمیر میں آباد کاری کا سلسلہ شروع ہوا، جس کے نتیجے کے طور پر گزشتہ برسوں میں جموں و کشمیر میں لاکھوں مقامی افراد اپنے روزگار سے محروم ہو گئے۔
ظلم پر ظلم سے جب بات نہیں بنی تو بھارت نے لاقانونیت کی ہر حد پار کر دی اور 6 اگست 2019 کو ‘ری آرگنائزیشن ایکٹ’ منظور کرایا گیا۔ اس ایکٹ نے مقبوضہ کشمیر کو دو حصوں (جموں و کشمیر اور لداخ) میں تقسیم کر کے دونوں خطوں کو بھارتی مرکزی حکومت کے براہِ راست زیرِ انتظام کر دیا اور وہاں ایک بظاہر بے اختیار قانون ساز اسمبلی قائم کی گئی۔ یوں ایک دن کشمیر کی ریاستی حیثیت ختم کی گئی اور اگلے روز تمام امور پر ان سے فیصلوں کا حق بھی چھین لیا گیا۔
ظلم اور لاقانونیت کی یہ داستان یہیں ختم نہیں ہوتی؛ ان کالے قوانین کے اطلاق کے بعد بھارتی حکومت نے کشمیر میں ایک ‘بلیک لسٹ’ متعارف کرائی، جس کے تحت صرف من پسند نیوز سائٹس کو چلنے کی اجازت دی گئی اور کشمیریوں کی دیگر تمام آزاد نیوز سائٹس تک رسائی ناممکن بنا دی گئی۔
وادی کی اس زبوں حالی پر فیض احمد فیض کی یہ سطریں بالکل صادق آتی ہیں(:”نثار میں تیری گلیوں کے اے وطن ”
کہ جہاں چلی ہے رسم کہ کوئی نہ سر اٹھا کے چلے”

بھارتی ظلم و جبر کی یہ داستان محض کشمیر تک ہی محدود نہیں ہے، بلکہ خود ہندوستان کے اپنے شہری اور اقلیتیں بھی اس کے شکنجے میں بری طرح پس رہی ہیں اور آئے روز ان پر معمولاتِ زندگی تنگ کیے جا رہے ہیں۔
‘قومی رجسٹر برائے شہریت’ (NRC) نے تو گویا اقلیتوں کو اپنا ماننے سے ہی انکار کر دیا ہے۔ اس رجسٹر میں نام درج کرانے کے لیے شہریوں کے پاس ‘لیگیسی دستاویزات’ کا ہونا لازمی ہے، اور جو بھی یہ ثبوت فراہم کرنے میں ناکام رہتا ہے، اس کی شہریت ضبط کر لی جاتی ہے۔ اس این آر سی نے 31 اگست 2019 کو جب اپنی پہلی لسٹ شائع کی، تو صرف آسام سے لگ بھگ 19 لاکھ بنگالیوں کو یکلخت غیر ملکی قرار دے کر ان کی شہریت چھین لی گئی۔ اس کے فوراً بعد، 11 دسمبر 2019 کو ‘سٹیزن شپ امینڈمنٹ ایکٹ’ (CAA) پاس کرایا گیا جس کے تحت اس متعصبانہ قانون کا دائرہ کار پورے ہندوستان پر پھیلا کر لوگوں کو ملک بدر ہونے پر مجبور کیا گیا۔
اس سے قبل، نومبر 2019 میں ‘ان لافل ایکٹیویٹیز پریوینشن ایکٹ’ (UAPA) پاس کیا گیا، جس نے دہشت گردی کی تعریف میں اتنی توسیع کر دی کہ چھوٹے سے چھوٹے سیاسی جرم یا احتجاج کو بھی دہشت گردی قرار دیا جانے لگا۔ یہ وہی ہندوتوا ذہنیت ہے جس نے مئی 2019 میں بابری مسجد کے قضیے کو ہوا دی اور اس کے بعد ہونے والے فسادات میں دو ہزار کے قریب بے گناہ مسلمان بے دردی سے قتل کر دیے گئے۔
بھارتیہ جنتا پارٹی (بی جے پی) درحقیقت آر ایس ایس کی کوکھ سے جنم لینے والی وہ کٹر پسند سیاسی جماعت ہے جس کی بنیاد 1980 میں رکھی گئی تھی۔ آزادی کے بعد سے مودی حکومت ملک کی سب سے بدعنوان اور فاشسٹ حکومت ثابت ہوئی ہے جس کی کارکردگی ہر محاذ پر قابلِ مذمت ہے۔ مودی سرکار کے اس آمریت پسند رویے کی وجہ سے خود ہندوستان کے اندر یہ خوف پیدا ہو چکا ہے کہ وہاں کی جمہوریت شدید خطرے میں ہے۔ بھارتی عوام اب جان چکے ہیں کہ ان حکمرانوں نے جھوٹے وعدے کر کے انہیں لُوٹا ہے اور ان کے مسائل حل کرنے کی مودی حکومت کی کوئی منشا ہی نہیں تھی۔
کشمیر میڈیا سروس کے مطابق، منوج جھا نے بھارتی سپریم کورٹ کی ویب سائٹ پر دستیاب خود سرکاری اعداد و شمار کا حوالہ دیتے ہوئے واضح کیا ہے کہ یہ صورتحال بی جے پی کے جعلی قوم پرستی کے دعوؤں کی نفی کرتی ہے اور سیاسی فائدے کے لیے مرکزی تفتیشی ایجنسیوں کے ننگے استعمال کو بے نقاب کرتی ہے۔پون صدی کا عرصہ گزرنے کے بعد اب بھی بھارت کی پورے مقبوضہ کشمیر میں انسانی حقوق کی مسلسل اور بے دریغ پامالیاں جاری ہیں۔ مقبوضہ کشمیر کرہ ارض کا وہ واحد خطہ ہے جہاں محض چند ہزار مربع میل علاقے میں آٹھ لاکھ سے زائد بھارتی قابض فوجی تعینات ہیں، اور بھارت سرزمینِ کشمیر پر اپنے اس جبری و ناجائز فوجی تسلط کو برقرار رکھنے کے لیے تمام تر ریاستی وسائل کو جھونک رہا ہے۔ یہ دن محض ایک رسمی احتجاج نہیں ہے، بلکہ یہ عالمی برادری اور انسانی حقوق کے علمبرداروں کے بند ضمیر کو جھنجھوڑنے کا دن ہے، جہاں سات سال سے جاری بدترین فوجی لاک ڈاؤن، حریت قیادت کی غیر قانونی قید اور معصوم نوجوانوں کی شہادتوں نے مقبوضہ وادی کو دنیا کی سب سے بڑی کھلی جیل میں تبدیل کر دیا ہے۔
بھارت تمام تر ظلم و جبر، تشدد اور ریاستی دہشت گردی کے باوجود اپنے مذموم مقاصد میں کامیاب نہیں ہو سکا اور نہ ہی وہ غیور کشمیریوں کے حوصلے پست کر سکا۔ ان کی جدوجہدِ آزادی کو روکنا اب نئی دہلی کے بس کی بات نہیں رہی اور اس حقیقت کو کسی طور جھٹلایا نہیں جا سکتا کہ مقبوضہ وادی کا بچہ بچہ، بزرگ، خواتین اور ہر جوان آزادی حاصل کرنے کے لیے پر عزم ہیں،
اور یہ بات اب بھارت کو بھی اچھی طرح سمجھ لینی چاہیے۔ کشمیریوں کے اسی فولادی عزم کو حبیب جالب نے یوں زبان دی تھی:ظلم رہے اور امن بھی ہوکیا ممکن ہے، تم ہی کہومقتل مقتل گونج رہی ہےاب تو یہ آواز، کہ بس!پاکستان نے ہمیشہ کشمیریوں کی سیاسی، سفارتی اور اخلاقی حمایت کی ہے اور آج ایک بار پھر ملکی قیادت اپنے مظلوم بھائیوں کے ساتھ دل و جان سے کھڑے ہونے کا آہنی عزم دہراتی ہے۔
پاکستان کا بچہ بچہ کشمیر کاز کے ساتھ وابستہ ہے، اور جب تک وادی کے غیور عوام کو اقوامِ متحدہ کی قراردادوں کے مطابق ان کا جائز حقِ خودارادیت نہیں مل جاتا، ہماری یہ حمایت پوری آب و تاب اور استقامت کے ساتھ جاری رہے گی۔ یہ وقت عالمی طاقتوں کے لیے بھی امتحان کا ہے کہ وہ مصلحتوں کی چادر اتار کر کشمیریوں کو ان کا حق دلائیں۔پاکستان نے ہمیشہ کشمیری عوام کی سیاسی، سفارتی اور اخلاقی سطح پر غیر متزلزل حمایت کی ہے اور حقِ خودارادیت کی اس جائز جنگ میں ہمیشہ ان کے شانہ بشانہ کھڑا رہا ہے۔ غاصب بھارت نے کشمیریوں کی آواز دبانے کے لیے ظلم و بربریت، غیر قانونی گرفتاریوں، بدترین تشدد اور ریاستی دہشت گردی کا ہر حربہ آزما لیا، لیکن وہ اپنے مذموم اور فاشسٹ مقاصد میں بری طرح ناکام رہا ہے۔ نئی دہلی سرکار طاقت کے اندھے استعمال کے باوجود نہ تو غیور کشمیریوں کے حوصلے پست کر سکی اور نہ ہی ان کی نسل در نسل منتقل ہونے والی جدوجہدِ آزادی کو روک سکی ہے۔ اس سچائی کو آج دنیا کا کوئی بھی خطہ جھٹلا نہیں سکتا کہ مقبوضہ وادی کا بچہ بچہ، بزرگ، خواتین اور نوجوان آزادی کے سوا کسی دوسرے متبادل پر راضی نہیں ہیں، اور یہ زمینی حقیقت اب بھارت کو بھی اچھی طرح سمجھ لینی چاہیے۔تاریخ کے آئینے میں دیکھا جائے تو 5 اگست 2019 مقبوضہ جموں و کشمیر کی تاریخ کا سب سے المناک، دردناک اور سیاہ ترین دن بن کر ابھرا۔ اپریل 2019 میں ہونے والے بھارتی عام انتخابات میں آر ایس ایس کی ہندوتوا آئیڈیالوجی پر چلنے والی بی جے پی بھاری اکثریت سے کامیاب ہوئی اور نریندر مودی نے دوسری بار وزارتِ عظمیٰ کا ہما اپنے سر پر سجایا۔ اقتدار سنبھالتے ہی اس متعصب حکومت نے سنگ دلی اور عصبیت کی تمام حدیں پار کرتے ہوئے کشمیریوں کے حقِ خودارادیت پر ننگا شب خون مارا اور ان کی داخلی خودمختاری کو براہِ راست چیلنج کیا۔ ابھی بی جے پی حکومت کو قائم ہوئے محض چار ماہ ہی گزرے تھے کہ انہوں نے بھارتی پارلیمان کو کٹھ پتلی بناتے ہوئے اندھے اور ظالمانہ قوانین پاس کرنے کا ایک گھناؤنا اور غیر جمہوری کھیل شروع کیا۔اسی فاشسٹ منصوبے کے تحت 5 اگست 2019 کو بھارتی پارلیمان نے آرٹیکل 370 کو یکطرفہ طور پر منسوخ کر دیا، جو جموں و کشمیر کو آئینی طور پر خصوصی نیم خودمختار حیثیت دیتا تھا اور اسے اپنا الگ آئین اور جھنڈا رکھنے کا قانونی حق فراہم کرتا تھا۔ اس دفعہ کے خاتمے کے ساتھ ہی کشمیر کی ریاستی شناخت مٹا دی گئی اور ان کا آئین و پرچم بھی زبردستی ضبط کر لیا گیا۔ ظلم کا یہ سلسلہ یہیں نہیں رکا، بلکہ بی جے پی حکومت نے ایک صدارتی حکم نامے کے ذریعے دفعہ 35 اے کو بھی جڑ سے اکھاڑ پھینکا۔ دفعہ 35 اے ایک ایسا حفاظتی ڈھال تھی جس کے تحت صرف وہی شخص جموں و کشمیر کا مستقل شہری بن سکتا تھا جو وہاں پیدا ہوا ہو یا اس کے پاس وہاں کی ریاستی شہریت ہو۔ اس قانون کے خاتمے کا مقصد کشمیر کے مسلم اکثریتی تشخص کو ہندو اقلیت میں بدلنا تھا، جس کے بعد بھارت کی دیگر ریاستوں سے سنگھی ہجوم اور غیر مقامی لوگوں کی وادی میں ہنگامی آباد کاری کا سلسلہ شروع کر دیا گیا۔ اس نوآبادیاتی پالیسی کے نتیجے میں مقامی معیشت تباہ ہو گئی اور گزشتہ برسوں کے دوران لاکھوں کشمیری اپنے ہی آبائی روزگار اور زمینوں سے محروم کر دیے گئے۔ جب ان تمام ہتھکنڈوں سے بھی کشمیریوں کا عزم نہ ٹوٹا، تو بھارت نے لاقانونیت کی تمام حدیں پار کرتے ہوئے اگلے ہی دن، یعنی 6 اگست 2019 کو ‘ری آرگنائزیشن ایکٹ’ بھی منظور کروا لیا تاکہ اس مقبوضہ خطے کو مستقل طور پر وفاق کے زیرِ انتظام ٹکڑوں میں تقسیم کیا جا سکےاس بدنامِ زمانہ ‘ری آرگنائزیشن ایکٹ’ نے تاریخی ریاستِ جموں و کشمیر کو جغرافیائی طور پر دو حصوں، یعنی ‘جموں و کشمیر’ اور ‘لداخ’ میں تقسیم کر دیا. ان دونوں خطوں کو کسی صوبائی حیثیت کے بجائے براہِ راست بھارتی مرکزی حکومت کے کنٹرول میں دے دیا گیا. اگرچہ دکھاوے کے لیے وہاں ایک قانون ساز اسمبلی کی گنجائش رکھی گئی، لیکن وہ عملی طور پر اتنی بے اختیار ہے کہ اس کی حیثیت ایک کٹھ پتلی سے زیادہ نہیں. یوں بی جے پی سرکار نے ایک ہی ہتھکنڈے کے تحت پہلے دن کشمیر کی تاریخی ریاستی حیثیت کا جنازہ نکالا اور اگلے ہی روز کشمیریوں سے ان کے اپنے مستقبل کا فیصلہ کرنے کا بنیادی حق بھی چھین لیا. ظلم، جبر اور ریاستی لاقانونیت کا یہ سیاہ باب ختم ہونے کا نام نہیں لے رہا. ان کالے قوانین کی آڑ میں بھارتی حکومت نے میڈیا پر سخت ترین سنسرشپ لگاتے ہوئے کشمیر میں ایک ‘بلیک لسٹ’ کا نظام متعارف کرایا، جس کے تحت صرف ان چیدہ چیدہ نیوز سائٹس کو چلنے کی اجازت دی جاتی ہے جو ہندوتوا بیانیے کی تائید کریں، جبکہ کشمیری عوام کے لیے باقی تمام آزاد اور غیر جانبدار نیوز پورٹلز تک رسائی کو مکمل طور پر بلاک اور ناممکن بنا دیا گیا ہے. دلچسپ بات یہ ہے کہ بھارتی ظلم و ستم کی یہ ہولناک داستان محض وادیِ کشمیر کی سرحدوں تک محدود نہیں رہی، بلکہ خود ہندوستان کے اپنے اندر بسنے والے کروڑوں شہری اور دیگر مذہبی اقلیتیں بھی اس فاشسٹ شکنجے میں بری طرح پس رہی ہیں. مودی راج میں اقلیتوں، خصوصاً مسلمانوں کے لیے آئے روز روزمرہ زندگی کے معمولات اور زمین تنگ کی جا رہی ہے. ‘قومی رجسٹر برائے شہریت’ (NRC) کے متعصبانہ قانون نے تو گویا ان اقلیتوں کو اپنے ہی وطن میں اجنبی بنا کر انہیں شہری ماننے سے ہی صاف انکار کر دیا ہے. شہریت کے اس نئے ڈیجیٹل رجسٹر میں نام برقرار رکھنے کے لیے یہ شرط عائد کی گئی ہے کہ ہر شہری کے پاس دہائیوں پرانی ‘لیگیسی دستاویزات’ (Legacy Documents) موجود ہوں. اب جو غریب، پسماندہ یا اقلیتی شہری مودی سرکار کے مقرر کردہ معیار کے مطابق یہ کاغذی ثبوت فراہم کرنے سے قاصر رہتا ہے، اس کی صدیوں پرانی ملکی شہریت چشمِ زدن میں ضبط کر لی جاتی ہے اور اسے اپنے ہی ملک میں بے وطن کر دیا جاتا ہے.ہندوتوا کے اس متعصبانہ ایجنڈے کے تحت بھارت کے ‘قومی رجسٹر برائے شہریت’ (NRC) نے 31 اگست 2019 کو جب اپنی پہلی حتمی فہرست شائع کی، تو ایک ہی جھٹکے میں ریاست آسام کے تقریباً 19 لاکھ بنگالیوں کو غیر ملکی قرار دے کر ان کی شہریت ضبط کر لی گئی اور انہیں اپنے ہی ملک میں پناہ گزین بنا دیا گیا۔ ظلم کا یہ دائرہ یہیں محدود نہ رہا، بلکہ اس کے محض چند ماہ بعد 11 دسمبر 2019 کو متنازع ‘سٹیزن شپ امینڈمنٹ ایکٹ’ (CAA) بھی پاس کروا لیا گیا۔ اس نئے قانون کے ذریعے این آر سی کا دائرہ کار پورے ہندوستان پر نافذ کر دیا گیا، جس کا بنیادی نشانہ مسلمان بنے؛ لاکھوں افراد کی شہریت چھین کر انہیں ملک بدر ہونے اور حراستی مراکز میں جانے پر مجبور کیا گیا。اسی سال نومبر 2019 میں ‘ان لافل ایکٹیویٹیز پریوینشن ایکٹ’ (UAPA) میں ایسی ترامیم کی گئیں جس نے دہشت گردی کی تعریف کو اس حد تک پھیلا دیا کہ چھوٹے سے چھوٹے سیاسی اختلاف، پرامن احتجاج یا حکومتی پالیسی پر تنقید کو بھی دہشت گردی قرار دے کر لوگوں کو بغیر ٹرائل کے جیلوں میں بند کیا جانے لگا۔ مودی سرکار کے اسی دورِ اقتدار میں مئی 2019 کے دوران بابری مسجد کے تاریخی قضیے کو ہندوتوا جنون کے لیے استعمال کیا گیا، اور اس کے نتیجے میں بھڑکنے والے مسلم کش فسادات میں دو ہزار کے قریب بے گناہ مسلمانوں کو بیدردی سے موت کے گھاٹ اتار دیا گیا۔درحقیقت، بھارتیہ جنتا پارٹی (بی جے پی) مسلم دشمن تنظیم آر ایس ایس (RSS) کی کوکھ سے جنم لینے والی جماعت ہے جس کی بنیاد 1980 میں رکھی گئی تھی۔ سنہ 1947 کی آزادی کے بعد سے اب تک مودی حکومت کو بھارت کی تاریخ کی سب سے بدعنوان، فاشسٹ اور نااہل حکومت قرار دیا جائے تو غلط نہ ہوگا، جس کی مجموعی کارکردگی ہر محاذ پر انتہائی قابلِ مذمت رہی ہے۔ آج خود ہندوستان کے اندر یہ خوف پوری طرح سر اٹھا چکا ہے کہ اگر یہ آمریت پسند اور ہندوتوا نواز مودی ٹولہ اقتدار پر قابض رہتا ہے، تو نام نہاد بھارتی جمہوریت کا بستر ہمیشہ کے لیے گول ہو جائے گا۔ وہاں کے عام عوام اب اچھی طرح سمجھ چکے ہیں کہ بی جے پی نے ترقی اور خوشحالی کے جھوٹے وعدے کر کے ان کا ووٹ بٹورا، جبکہ ان کے مسائل حل کرنے کی ان کی کوئی نیت ہی نہیں تھی۔ کشمیر میڈیا سروس کے مطابق، بھارتی رہنما منوج جھا نے خود بھارتی سپریم کورٹ کی ویب سائٹ پر موجود سرکاری اعداد و شمار کا حوالہ دیتے ہوئے واضح کیا ہے کہ یہ سنگین صورتحال بی جے پی کے کھوکھلے قوم پرستی کے دعوؤں کا پردہ چاک کرتی ہے اور یہ ثابت کرتی ہے کہ مودی حکومت اپنے سیاسی فائدے اور مخالفین کو دبانے کے لیے مرکزی تفتیشی ایجنسیوں کا ننگا اور بے دریغ استعمال کر رہی ہےبلومبرگ کی ایک حالیہ رپورٹ اس تلخ حقیقت کی تصدیق کرتی ہے کہ 2014 میں نریندر مودی کے برسرِ اقتدار آنے کے بعد سے بھارتی معاشرے میں مسلمانوں کے خلاف تعصب اور نفرت کا رجحان خطرناک حد تک بڑھ چکا ہے۔ رپورٹ کے مطابق، مسلمانوں کے خلاف نفرت انگیز تقاریر (Hate Speech) کے ریکارڈ شدہ 255 واقعات میں سے تقریباً 80 فیصد واقعات صرف ان ریاستوں میں پیش آئے جہاں بی جے پی کی حکومت ہے۔ مودی سرکار نے وادی میں اٹھنے والی ہر سیاسی اور نظریاتی آواز کو دبانے کے لیے تحریکِ آزادیِ کشمیر میں کلیدی کردار ادا کرنے والی چوٹی کی تنظیموں پر یکطرفہ پابندیاں چارٹر کا آرٹیکل 1 دنیا کے تمام پسماندہ اور زیرِ دست لوگوں کو اپنے مستقبل کا فیصلہ خود کرنے یعنی ‘حقِ خودارادیت’ کی ضمانت دیتا ہے، مگر تاریخ شاہد ہے کہ محض کاغذ پر لکھے قوانین کسی تحریک کو اس وقت تک کامیابی سے ہمکنار نہیں کر سکتے جب تک عالمی طاقتوں کی سیاسی رضامندی شاملِ حال نہ ہو. اس دہرے معیار کی سب سے بڑی مثال سوڈان کی تقسیم اور ایسٹ تیمور کی تخلیق ہیں جنہیں عالمی برادری نے فوری تسلیم کیا، جبکہ کشمیر اور فلسطین کے دیرینہ تنازعات دہائیاں گزرنے کے بعد بھی عالمی ضمیر اور بین الاقوامی نظام پر ایک بہت بڑا سوالیہ نشان بنے ہوئے ہیں. مصلحت پسند دنیا کی اس بے حسی کے باعث کشمیری عوام کے لیے سیاسی نمائندگی، اعلیٰ تعلیم، آزادیِ اظہارِ رائے اور خود زندگی کا حق جیسے بنیادی انسانی حقوق ایک خواب بن کر رہ گئے ہیں، اور افسوس کا مقام یہ ہے کہ جمہوریت اور انسانی حقوق کے نام نہاد عالمی علمبردار اپنے تجارتی و معاشی مفادات کی خاطر نئی دہلی کی ان انسان دشمن پالیسیوں اور کالے قوانین پر مجرمانہ خاموشی اختیار کیے بیٹھے ہیں.اقوامِ متحدہ کی اپنی انسانی حقوق کونسل کی جانب سے مقبوضہ کشمیر میں جاری بھارتی جارحیت پر متعدد تفصیلی رپورٹس جاری ہونے کے باوجود، جارح بھارت کا ہاتھ نہ روکنا اور مظلوم کشمیریوں کے حق میں آواز بلند نہ کرنا عالمی برادری کی کھلی منافقت اور مجرمانہ غفلت کا منہ بولتا ثبوت ہے. اس عالمی سرد مہری کے باوجود پاکستان اپنے اس اصولی موقف پر چٹان کی طرح قائم ہے کہ کشمیری عوام کے ناقابلِ تنسیخ حقِ خودارادیت کے حصول تک ان کی مضبوط، غیر متزلزل اور ثابت قدم اخلاقی، سیاسی اور سفارتی حمایت جاری رکھی جائے گی. پاکستان خطے میں پائیدار ترقی کے لیے بھارت سمیت اپنے تمام پڑوسیوں کے ساتھ پرامن اور دوستانہ تعلقات کا خواہاں ہے، تاہم نئی دہلی کو یہ بات ذہن نشین کر لینی چاہیے کہ اچھے تعلقات دیرینہ تنازعات سے نظریں چرانے یا انہیں پسِ پشت ڈالنے سے نہیں، بلکہ انہیں اقوامِ متحدہ کی قراردادوں کے مطابق نیک نیتی سے حل کرنے سے ہی قائم ہو سکتے ہیں.مقبوضہ جموں و کشمیر کی آزادی کی تحریک ایک ‘جہدِ مسلسل’ ہے، جسے سال کے چند مخصوص دنوں یا تاریخوں سے منسوب کر کے صرف رسمی آواز بلند کرنے تک محدود نہیں کیا جا سکتا؛ بلکہ ضرورت اس امر کی ہے کہ ہر وقت، ہر لمحے اور ہر گھڑی کشمیر کی مظلومیت اور ان کے حقوق کی آواز بن کر دنیا کے ایوانوں کو جھنجھوڑا جائے. کشمیری عوام کا یہ پختہ اور آہنی عزم ہے کہ وہ غاصب بھارت کے ہندوتوا پر مبنی گھناؤنے اقدامات کو کبھی کامیاب نہیں ہونے دیں گے اور اقوامِ متحدہ کی سلامتی کونسل کی قراردادوں کے عین مطابق اپنی اس جدوجہدِ آزادی کو حقیقی منزل کے حصول تک جاری رکھیں گے، کیونکہ جنوبی ایشیا میں دیرپا امن اور خوشحالی کا خواب جموں و کشمیر کے منصفانہ حل کے بغیر کبھی شرمندہ تعبیر نہیں ہو سکتا۔

Seven long years have now passed since the night of illegal siege and oppression imposed by India on occupied Jammu and Kashmir. The day of August 5, 2019, is counted among the darkest chapters in history when the Modi government, flouting international laws, ethics and its own constitution, killed the special identity of the valley.
In fact, August 5, 2019 is the most tragic, painful and darkest day in the history of occupied Jammu and Kashmir when Kashmir’s right to self-determination was attacked, and its autonomy was challenged.
How beautifully did the poet of the East, Allama Iqbal, describe the beauty of the valley and the heart-wrenching conditions there:

In April 2019, the RSS-led BJP party won the general elections in India, and Narendra Modi returned to power. After coming to power, this government took the biggest step of heartlessness and bigotry, and it was only four months after the formation of the BJP government that they started the heinous process of passing blind laws from the parliament. Under this link, on August 5, 2019, the Indian Parliament abolished Article 370, which gave special status to Kashmir and provided it with its own constitution and flag. The abrogation of this article ended Kashmir’s special status and also confiscated its constitution and flag. Not only that, but the BJP government also abolished Article 35A through a presidential decree, according to which a person could be a citizen of Jammu and Kashmir only if he were born there.
After the abrogation of Article 35A, the process of settlement of non-local people from other states of India began in Kashmir, as a result of which lakhs of local people in Jammu and Kashmir lost their jobs in the past years.
When oppression did not suffice, India crossed all limits of lawlessness and passed the ‘Reorganization Act’ on August 6, 2019. This act divided occupied Kashmir into two parts (Jammu and Kashmir and Ladakh) and placed both regions directly under the administration of the Indian central government, and an apparently powerless legislative assembly was established there. Thus, one day Kashmir’s statehood was abolished, and the next day they were deprived of their right to make decisions on all matters.
This story of oppression and lawlessness does not end here; after the implementation of these black laws, the Indian government introduced a ‘blacklist’ in Kashmir, under which only preferred news sites were allowed to operate and access to all other independent news sites by Kashmiris was made impossible.

This story of Indian oppression and oppression is not limited to Kashmir alone, but India’s own citizens and minorities are also suffering badly in its grip, and their daily routines are being restricted day by day.
The ‘National Register of Citizens’ (NRC) has seemingly refused to recognise minorities. Citizens must have ‘legacy documents’ to be included in this register, and anyone who fails to provide this proof is stripped of their citizenship. When the NRC published its first list on August 31, 2019, it declared around 1.9 million Bengalis from Assam alone as foreigners and stripped them of their citizenship. Soon after, the ‘Citizenship Amendment Act’ (CAA) was passed on December 11, 2019, under which the scope of this discriminatory law was extended to the whole of India, and people were forced to be deported.
Earlier, the ‘Unlawful Activities Prevention Act’ (UAPA) was passed in November 2019, which broadened the definition of terrorism to such an extent that even the smallest political crime or protest was declared terrorism. This is the same Hindutva mentality that fueled the Babri Masjid case in May 2019 and the subsequent riots in which around 2,000 innocent Muslims were brutally killed.
The Bharatiya Janata Party (BJP) is actually a hardline political party born from the womb of the RSS and was founded in 1980. Since independence, the Modi government has proven to be the most corrupt and fascist government in the country, whose performance is condemnable on every front. Due to this authoritarian behavior of the Modi government, there has been a fear within India itself that its democracy is in grave danger. The people of India have now come to know that these rulers have robbed them by making false promises, and the Modi government has no intention of solving their problems.
According to Kashmir Media Service, Manoj Jha, citing official figures available on the website of the Supreme Court of India, has made it clear that this situation belies the BJP’s claims of fake nationalism and exposes the blatant use of central investigative agencies for political gain. After a period of five centuries, India continues to commit continuous and unbridled human rights violations throughout occupied Kashmir. Occupied Kashmir is the only region on the planet where more than eight lakh Indian occupying troops are deployed in an area of ​​just a few thousand square miles, and India is pouring all state resources to maintain its forced and illegal military rule over the land of Kashmir. This day is not just a formal protest, but it is a day to shake the conscience of the international community and human rights activists, where the worst military lockdown that has been going on for seven years, the illegal imprisonment of the Hurriyat leadership and the martyrdom of innocent youth have turned the occupied valley into the world’s largest open prison.
Despite all the oppression, violence and state terrorism, India could not succeed in its nefarious objectives nor could it demoralize the brave Kashmiris. Stopping their freedom struggle is no longer a matter for New Delhi, and there is no denying the fact that the children, the elderly, the women and every youth of the occupied valley are determined to achieve freedom,
and India should also understand this well now. This iron resolve of the Kashmiris was expressed by Habib Jalib in this way: Is it possible for there to be oppression and peace? You say, “Murder is murder.” Now this voice is resounding: “Enough!” Pakistan has always supported the Kashmiris politically, diplomatically and morally, and today, once again, the country’s leadership reiterates its iron resolve to stand with its oppressed brothers with all its heart and soul. Every child of Pakistan is committed to the Kashmir cause, and until the brave people of the valley get their legitimate right to self-determination in accordance with the resolutions of the United Nations, our support will continue with full vigor and steadfastness. This time is also a test for the world powers to shed the cloak of expediency and give the Kashmiris their right. Pakistan has always supported the Kashmiri people unwaveringly on the political, diplomatic and moral levels and has always stood by them in this legitimate fight for the right to self-determination. The occupying India has tried every tactic of cruelty, illegal arrests, worst violence and state terrorism to suppress the voice of Kashmiris, but it has failed miserably in its nefarious and fascist objectives. Despite the blind use of force, the New Delhi government has neither been able to demoralize the brave Kashmiris nor stop their generational struggle for freedom. No region in the world can deny this truth today: the children, elders, women and youth of the occupied valley are not satisfied with any other alternative but freedom, and India should also understand this ground reality well now. If we look at the mirror of history, August 5, 2019 has emerged as the most tragic, painful and darkest day in the history of occupied Jammu and Kashmir. In the Indian general elections held in April 2019, the BJP, which runs on the Hindutva ideology of the RSS, won with a landslide victory and Narendra Modi donned the crown of the Prime Minister for the second time. As soon as it took power, this fanatical government crossed all limits of callousness and bigotry and openly attacked the right of Kashmiris to self-determination and directly challenged their internal autonomy. It had only been four months since the BJP government was formed that it started a heinous and undemocratic game of passing blind and oppressive laws by making the Indian Parliament a puppet. Under the same fascist plan, on August 5, 2019, the Indian Parliament unilaterally revoked Article 370, which constitutionally gave Jammu and Kashmir a special semi-autonomous status and gave it the legal right to have its own constitution and flag. With the abolition of this article, Kashmir’s statehood was erased, and its constitution and flag were also forcibly confiscated. This cycle of oppression did not stop here, but the BJP government also uprooted Article 35A through a presidential order. Article 35A was a protective shield under which only those who were born there or had state citizenship could become permanent citizens of Jammu and Kashmir. The abolition of this law aimed to transform the Muslim majority identity of Kashmir into a Hindu minority, after which a series of emergency resettlements of Sangh mobs and non-locals from other states of India began in the valley. As a result of this colonial policy, the local economy was destroyed, and millions of Kashmiris were deprived of their ancestral livelihood and lands over the years. When all these tactics did not break the resolve of the Kashmiris, India crossed all limits of lawlessness and passed the ‘Reorganization Act’ on the very next day, i.e., 6 August 2019, to permanently divide this occupied region into federally administered pieces. This infamous ‘Reorganization Act’ geographically divided the historic state of Jammu and Kashmir into two parts, namely ‘Jammu and Kashmir’ and ‘Ladakh’. Both these regions were given direct control of the Indian central government instead of provincial status. Although a legislative assembly was set up there for show, it is so powerless in practice that its status is no more than a puppet. Thus, the BJP government, under a single tactic, held a funeral for Kashmir’s historic statehood on the first day and took away the fundamental right of the Kashmiris to decide their own future the very next day. This dark chapter of oppression, repression and state lawlessness is not coming to an end. Under the guise of these black laws, the Indian government imposed the strictest censorship on the media and introduced a ‘blacklist’ system in Kashmir, under which only those selected news sites that support the Hindutva narrative are allowed to operate, while access to all other independent and impartial news portals has been completely blocked and made impossible for the Kashmiri people.Interestingly, this horrific story of Indian oppression is not limited to the borders of the Kashmir Valley, but millions of citizens and other religious minorities living within India itself are also suffering badly in this fascist grip. Under Modi’s rule, the routines of daily life and land are being reduced day by day for minorities, especially Muslims. The biased law of the ‘National Register of Citizens’ (NRC) has made these minorities strangers in their own country and has flatly refused to consider them citizens. To maintain their name in this new digital register of citizenship, it has been made a condition that every citizen must have decades-old ‘Legacy Documents’. Now, a poor, backward or minority citizen who is unable to provide this paper proof as per the criteria set by the Modi government has his centuries-old citizenship confiscated in the blink of an eye and is made stateless in his own country. Under this partisan agenda of Hindutva, when India’s ‘National Register of Citizens’ (NRC) published its first final list on August 31, 2019, in one fell swoop, about 1.9 million Bengalis from the state of Assam were declared foreigners and their citizenship was confiscated, and they were made refugees in their own country. This scope of oppression did not stop here, but just a few months later, the controversial ‘Citizenship Amendment Act’ (CAA) was also passed on December 11, 2019. Through this new law, the scope of NRC was implemented across India, the main target of which was Muslims; Millions of people were stripped of their citizenship and forced into exile and detention centers. In November 2019, the Unlawful Activities Prevention Act (UAPA) was amended to broaden the definition of terrorism to the point that even the smallest political dissent, peaceful protest, or criticism of government policy was considered terrorism and people were imprisoned without trial. During the same period of the Modi government, the historic Babri Masjid case was used to fuel Hindutva fanaticism in May 2019, and in the resulting anti-Muslim riots, nearly two thousand innocent Muslims were brutally killed. In fact, the Bharatiya Janata Party (BJP) is a party born from the womb of the anti-Muslim organization RSS, which was founded in 1980. It would not be wrong to call the Modi government the most corrupt, fascist and incompetent government in the history of India since independence in 1947, whose overall performance on every front has been highly condemnable. Today, the fear has fully risen within India itself that if this authoritarian and pro-Hindutva Modi clique continues to hold power, then the bed of the so-called Indian democracy will be round forever. The common people there have now understood very well that the BJP got their votes by making false promises of development and prosperity, while it had no intention of solving their problems. According to Kashmir Media Service, Indian leader Manoj Jha himself, citing official data available on the website of the Indian Supreme Court, has made it clear that this serious situation exposes the BJP’s hollow nationalist claims and proves that the Modi government is blatantly and blatantly using the central investigation agencies for its political gain and to suppress its opponents. A recent report by Bloomberg confirms the bitter truth that the trend of prejudice and hatred against Muslims in Indian society has increased to an alarming extent since Narendra Modi came to power in 2014. According to the report, out of the 255 recorded incidents of hate speech against Muslims, about 80 percent of the incidents occurred only in states where the BJP is in power. To suppress every political and ideological voice in the valley, the Modi government has imposed unilateral restrictions on the top organizations that played a key role in the Kashmir freedom movement, including Jamaat-e-Islami of Occupied Jammu and Kashmir, Muslim League, Tehreek-e-Hurriyat, Democratic Freedom Party, Jammu and Kashmir Liberation Front (JKLF), Dukhtar-e-Millat and Muslim Conference. Although Article 1 of the UN Charter guarantees the ‘right of self-determination’ to all the backward and oppressed peoples of the world, history is witness that mere laws written on paper cannot make any movement successful unless the political consent of the world powers is present. The biggest example of this double standard is the partition of Sudan and the creation of East Timor, which were immediately recognized by the international community, while the long-standing conflicts of Kashmir and Palestine remain a huge question mark on the global conscience and the international system even after decades. Due to this indifference of the expedient world, basic human rights like political representation, higher education, freedom of expression and the right to life itself have become a dream for the Kashmiri people, and it is a matter of regret that the so-called global champions of democracy and human rights have maintained a criminal silence on these inhuman policies and black laws of New Delhi for the sake of their commercial and economic interests. Despite the issuance of several detailed reports on the ongoing Indian aggression in occupied Kashmir by the United Nations’ own Human Rights Council, the failure to stop the aggressor India and not raise its voice in favor of the oppressed Kashmiris is clear proof of the hypocrisy and criminal negligence of the international community.
